are valid for all online orders via our VITALSAN.com - Homepage. Any
changes are valid with our written confirmation only.
§ 2 Conclusion of a contract
All declarations of articles and prices are without engagement. The
clicking of the order button "Buy now" places a binding order for the
products present in the shopping cart. A binding order for VITALSAN
does not accomplish until the goods have been sent out to the customer.
Until then VITALSAN has the right to forbear from delivering in case of
unavailability. For non delivered products of one and the same order
does not result a contract of purchase.
VITALSAN does not offer products to purchase by minors. Our products
for children are to purchase by adults only.
If you use this site, you are responsible for maintaining the
confidentiality of your account and password and for restricting access
to your computer, and you agree to accept responsibility for all
activities (e.g. orders) that occur under your account or password.
§ 3 Revocation
The right of withdrawal concerns unused products in original packing
only. Damaged products are excluded from replacement.
§ 4 Shipment
The delivery is effected ex stock directly to the delivery address.
Terms of delivery are non binding. Part deliveries are possible.
Mailing expenses due to unjustified reconsignment are for customers
account.
§ 5 Payment and retention of title
You can pay with credit card only (American Express,
Eurocard/Mastercard, VISA).
We do not charge your credit card until your order has entered the
shipping process.
The goods remain in our property until complete payment.
§ 6 Defects
Illustrations of products must not be identical with their real
look. Changes of the product configuration are possible. Changes are no
defects if they are reasonable for the customer.
In case of defects we will remedy deficiencies as soon as possible
or replace the article. If this requires a disproportional high cost we
are authorised to fulfil in another way. in case of replacement of an
article the defect goods have to bee sent back immediately. Other
claims of the customer are excluded. VITALSAN.com is not liable for any
direct, indirect, special, indicental, consequential or exemplary
damages that may result from our goods or services. Compensation claims
are not valid in case of defects caused by deliberate or wantonly
negligent actions.
§ 7 Privacy/Credit check
All personal data on this website are given voluntary by the
customer. We will memorize all data that are necessary for our
fulfilling our business. All personal data are kept in confidence. More
details regarding your privacy on our website you will find in our Privacy
Statement.
The user is bound to keep his username and passwort in a secure mode
and not to hand it to third persons. In case of lost, the user has to
inform the webmaster immediately.
We reserve the right to make enquires about your previous payment
history and/or your creditworthiness.

We reserve all of our rights, including but not limited to any and
all copyrights, trademarks, patents, trade secrets and any other
proprietary right that we may have in our web site, its content and the
goods and services that may be provided. The use of our rights and
property requires our written consent. We are not providing you with

to you and you will have no rights to make any commercial uses of our

authorisation can be revoked. In that case any use has to be stopt

The contract is subject to the written form. Verbal, collateral
agreements are not applicable. Alternations to the contract, also
cancellations of formal requirements must be submitted in written form.
Should a clause or part of the contractual clause be or become
invalid the validity or legality of the remaining contract is not
influenced thereby. As long as the clauses have not become part
of the contract or invalid then the content of the contract is directed
by the legal regulations.
